Williamsport Deck & Fence provides residential and light commercial deck building, fence installation, and related outdoor construction services in Pennsylvania and surrounding areas. Services are performed at the customer's property location. We reserve the right to decline any project at our discretion. All work is performed in accordance with applicable building codes and permit requirements.
All estimates are provided free of charge and in writing following an on-site visit. An estimate is not a binding contract. A signed written agreement (proposal or contract) is required before any work begins.
Prices quoted in an estimate are based on the scope of work described at the time of the estimate. If conditions discovered during work (such as rotted structural members, hidden utilities, or unforeseen site conditions) require a change in scope, we will notify you in writing before proceeding with any additional work. You will not be charged for changes you have not approved in writing.
Material prices are subject to market fluctuations. If significant price changes occur between the estimate date and project start, we will notify you before proceeding.
Project start dates are estimates and may be affected by weather, permit approval timelines, material availability, and prior project completions. We will communicate scheduling updates to you as they arise.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellation policies, including any deposit terms, are specified in your signed project agreement. We reserve the right to retain any non-refundable deposit amounts as described in that agreement.
We reserve the right to reschedule or suspend work due to unsafe weather conditions, site access issues, or circumstances beyond our control. We will not be liable for delays caused by such conditions.
Payment terms are set forth in your signed project agreement. A deposit is typically required before work begins. The remaining balance is due upon project completion unless otherwise specified in writing.
Accepted payment methods are listed in your project agreement. Invoices not paid by the due date may be subject to a late payment fee as described in your agreement. We reserve the right to suspend work on projects with outstanding unpaid balances.
In the event that collection proceedings are necessary to recover unpaid amounts, you agree to pay all reasonable collection costs, including attorney fees, to the extent permitted by law.
Where required, we will obtain the necessary building permits on your behalf as part of the project. Permit fees are included in or separately itemized within your written estimate. You agree to cooperate with any inspection requirements, including providing reasonable access to your property. Projects that require permits will not begin construction until permits are approved. We are not responsible for delays caused by permit office processing times.
You are responsible for providing clear and accurate information about your property, including any known easements, underground utilities, deed restrictions, or HOA rules that may affect the project. We recommend calling your local utility notification service before any excavation work begins.
You are responsible for ensuring the work area is accessible and free of personal property, vehicles, and obstructions during project work days.
Workmanship warranties, if any, are described in your signed project agreement. Material warranties are provided by the respective manufacturers and are passed through to you as the customer. We do not make any additional warranties beyond those expressly stated in your project agreement.
Warranty coverage does not apply to damage caused by improper use, neglect, acts of nature, modifications made by anyone other than us, or failure to follow recommended maintenance procedures. Normal weathering, color change, and surface wear of natural wood products are not covered under any workmanship warranty.
To the maximum extent permitted by applicable law, Williamsport Deck & Fence shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to our services or these Terms, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a specific project shall not exceed the total amount paid by you for that project.
If a dispute arises between you and Williamsport Deck & Fence relating to our services or these Terms, both parties agree to first attempt to resolve the dispute through direct, good-faith negotiation.
If direct negotiation does not resolve the dispute within 30 days, both parties agree to submit the dispute to binding arbitration in Williamsport, PA, under the rules of a mutually agreed arbitration provider. The decision of the arbitrator shall be final and binding. This arbitration agreement does not prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms and Conditions, and any dispute arising under them, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal proceedings not subject to the arbitration clause above shall be brought in the appropriate courts of Pennsylvania.
All content on our Site - including text, images, logos, and layout - is the property of Williamsport Deck & Fence or our content providers and is protected by applicable copyright and intellectual property law. You may not reproduce, distribute, or use our content for commercial purposes without our express written permission. Personal, non-commercial use of the Site for the purpose of learning about our services is permitted.
We reserve the right to modify these Terms and Conditions at any time. Changes are effective immediately upon posting to the Site.
